4 FRIDAY, AUGUST 9, 2002 2 women, toddler hurt in truck accident BY STAFF WRITER LARA BECKER LIU Three people were injured one critically after being struck by a Federal Express truck in Brighton. Brighton Police Sgt. Mark Henderson said a 35-year-old woman suffered massive head injuries and was rushed into surgery at Strong Memorial Hospital. Marcy Ann Betts, of 140 Fairhaven Road, Brighton, was in guarded condition, hospital officials said. Sara Blake, 26, whose address was not given, suffered neck and back injuries and her 3-year-old daughter, Kaleya Blake, suffered multiple fractures.

They were being evaluated and were listed in satisfactory condition at Strong. A 1-year-old child next to the 3-year-old was not injured. Henderson believed the victims were either in a yard or on the sidewalk. The accident occurred about 5:15 p.m. on Fairhaven Road, which runs between Blossom Road and Browncroft Boulevard just west of Route 590.

Henderson said the driver of the truck was not injured and was being questioned. The truck, which was heading toward Blossom Road, came to rest against a house at 170 Fairhaven after striking a tree, which had bark ripped off the trunk. Witnesses reported hearing the truck brake dramatically. "I saw the truck lose control and go between the tree and the house," said a neighbor, Ellen Norris, 48. "I heard children screaming and my daughter saw a little girl go flying off her bike.

I saw a woman motionless in front of the house and I thought she was It was very traumatic to see. It was tough to look at. All I could do was pray." An accident reconstruction team from the State Police responded to the scene. The speed limit on the street is 25 mph. A representative from Federal Express also came to the scene but would not comment.

Flames shot up more than 60 feet from the road after the gas ignited at 10:36 a.m., said Canandaigua Firefighter Brian Kransler. Firefighters needed to wait for more than two hours before the gas could be shut off and the fire extinguished, he said.

State Capitol restores its opening to sky THE ASSOCIATED PRESS ALBANY Daylight flooded the state Capitol's western staircase Thursday as workers unveiled a restored skylight, not publicly seen since it was covered during World War II to avoid providing a lighted target for Nazi bombers. "All I can say is, said Kenneth Ringler state commissioner of general services, as workers pulled off the tarp. Gov. George Pataki gave a thumbs-up, and onlookers erupted in applause as they stared into blue skies. The structure consists of two layers: The domed "laylight" 55 feet above the Capitol's fourth floor, and the peaked skylight, or roof, 55 feet higher.

"This is more than just a building. This is personal," said Assemblyman John McEneny, an Albany Democrat whose greatgrandfather worked on the Capitol for 30 years. DemocratandChronicle.com FAIR HAVEN Boater's death linked to storm Investigators say a combination of darkness and a torrential downpour likely caused a boater to misjudge his direction and hit a breakwater in Lake Ontario. David Fox, 37, was thrown from the boat and landed on the rocks of the breakwater at Fair Haven State Park in Little Sodus Bay, where his body was found about 7 a.m. Monday by a fisherman.

Airport guard forces mom to drink own breast milk THE ASSOCIATED PRESS ACROSS THE STATE LEY CREEK Mosquito trap yields Nile virus Mosquitoes testing positive for the West Nile virus have been caught in an upstate county, the first outside of New York City, health officials said. Until now, only infected dead birds had been found in Onondaga County. Despite the positive test result, county Health Commissioner Lloyd Novick said Thursday that there was no reason to spray pesticides. Spraying will be considered only i in cases in which large clusters of infected birds or other indicators of a human health risk are found, he said.

NEW YORK A woman, a baby and three milk-filled bottles. That scene prompted a security guard at John F. Kennedy International Airport to force a Long Island mother to drink from three bottles filled with her own breast milk. The demand, part of a postSept. 11 increase in airport security, was apparently made to ensure the liquid posed no threat to other passengers.

The requirement was within federal guidelines at the time, but the policy has since been changed. Elizabeth McGarry, 40, of Oceanside said the incident occurred April 2 as she was boarding a Delta Air Lines flight for Miami with her infant daughter. She called it "embarrassing and disgusting" when a security guard forced her to drink from the bottles before boarding. "The number of middle-aged, lactating white women who passed through al-Qaeda training is probably negligible," said attorney Ronald Kuby, who fielded a telephone call Wednesday from McGarry on his New York radio talk show. Kuby, who later spoke with McGarry about her legal options, said the woman was not looking to file a lawsuit over the incident although that remained a possibility.

"She's primarily concerned this doesn't happen to somebody else," Kuby said. "She does feel the people who did this were plain stupid and should be punished in some way." McGarry and her daughter, Maggie, were pulled out of the boarding line for a random search. Guards examined her shoes, searched her baby and went through her diaper bag. "None of that bothered her," Kuby said. "Only when she was ordered to drink the breast milk did she fail to see the connection to stopping terrorism." The U.S.

Mom says school made her give Ritalin to son THE ASSOCIATED PRESS MILLBROOK A mother says I her son's behavioral problems got worse after school officials gave her an ultimatum: Put the first-grader on Ritalin or he'll be placed in special education classes. Patricia Weathers has filed notice that she will sue the Millbrook Central School District on behalf of her son, Michael Mozer, for the mental and physical pain she says he suffered for two years starting in 1997. Michael, she said, had trouble focusing and was easily distracted. Officials in the Dutchess County school referred her son to a pediatrician who prescribed Ritalin, Weathers said.

By the third grade, Michael was suffering from insomnia, he lost his appetite and was so anxious he chewed his shirt sleeves, collars and pencils, she said. School officials suggested more medication, she said. Michael began taking another version of Ritalin plus Paxil, an -anxiety drug. "He was having side effects that were making him literally psychotic at one point," she said. Michael's behavior improved on weekends and over breaks, when she would not give him the drugs, she said.

She finally stopped medicating her son in December 1999 after he told her voices in his head were telling him to do bad things, she said. Michael, now 12, was prohibited from entering the school, Weathers said. She now homeschools him and another son. In February 2000, school officials filed a complaint with the state Department of Children and Family Services, Weathers said. An investigation cleared her of wrongdoing after independent psychiatric evaluations found her son's sickness was related to the drugs.

An employee in Millbrook Superintendent W. Michael Mahoney's office said the district would not comment. The Department of Children and Family Services declined comment, citing confidentiality, a spokesman said. If a construction deal worked out by the Senecas contains the proper protections for union organizing, Gov. George Pataki might sign a compact as early as next week to bring casino gambling to New York. "We're very pleased with what we're hearing from the Senecas," Pataki spokeswoman Suzanne Morris said Thursday. "We look forward to receiving the documents from them, hope to have them in hand as early as today."
